This Privacy Policy covers information we collect about visitors, leads, and business contacts of prospective or existing clients. It does not cover data that GrowingBiz processes on behalf of a client as part of a paid engagement — that data is governed by the applicable Commercial Agreement and, where required, by a separate Data Processing Agreement between GrowingBiz and the client. For the purposes of the European Union General Data Protection Regulation ("GDPR") and the UK GDPR, Strauss Holdings LLC is the data controller of your personal data. For the purposes of the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), Strauss Holdings LLC is the business that determines the purposes and means of processing your personal information.

Where AI-powered features are used internally by GrowingBiz to draft communications, analyze information, or otherwise support our business operations, information may be transmitted to AI providers (including Anthropic and OpenAI) under those providers' business or enterprise terms, which include commitments not to use inputs to train their models.
- Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality arrangements.
- Legal and safety. We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

12. Client Data Processed on Behalf of Clients
When GrowingBiz delivers services under a Commercial Agreement, we may access, process, or transmit personal data that belongs to our client or to the client's own customers, contacts, employees, or business operations ("Client Data"). In relation to Client Data:
- (a) our client is the data controller and GrowingBiz acts as data processor or service provider on the client's behalf;
- (b) our processing of Client Data is governed by the applicable Commercial Agreement and, where required by law, by a separate Data Processing Agreement executed between GrowingBiz and the client;
- (c) this Privacy Policy does not apply to Client Data; the client's own privacy policy applies to end users;
- (d) if you are an end user, employee, or customer of one of our clients and you have questions about how your personal data is processed, please contact that client directly. GrowingBiz will forward requests received about Client Data to the applicable client.
13. Artificial Intelligence and Automated Processing
We use AI-powered tools internally to support our business operations (such as drafting emails, analyzing information, and organizing knowledge). These uses are covered under Section 5 above. We do not make decisions based solely on automated processing that produce legal or similarly significant effects concerning you.
Where AI-powered features are part of a solution we deliver to a client, the use of AI and the handling of data are governed by the applicable Commercial Agreement between GrowingBiz and the client, not by this Privacy Policy.
14. Children's Privacy
The Services are directed to business users. Individuals under the age of eighteen (18) are not permitted to use the Services. We do not knowingly collect personal information from children. 15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised version on our website and update the "Last updated" date.
